Meeting the Criteria of the Vaccine Injury Table: Vaccination Type

The first step in the claims process in proving your vaccine injury case is to make sure the vaccine you received is one that is covered in the program. Only the vaccines listed on the program’s Vaccine Injury Table are eligible for compensation through the VICP. There are no exceptions. Of note, any individual who experienced an adverse effect from a vaccine not named on the table is free to pursue direct legal action against the company that manufactured the vaccine and/or the individual who administered the inoculation but that would not be covered under the VICP.

Meeting the Criteria of the Vaccine Injury Table: Vaccination Injury

Certain vaccines are known to trigger or cause certain injuries. Compensation is easier if the injury from the vaccine is one listed on the Vaccine Injury Table, maintained by the program. While it's normal to have some shoulder pain after a vaccine, any vaccination can cause permanent swelling and nerve injuries at the site of injection as well as rotator cuff injury, frozen shoulder, and/or brachial neuritis. If any of these complications from a vaccine administration occur and last more than six (6) months after the vaccination or result in a surgical procedure, then you may have a claim and be entitled to compensation.
